This website is intended for the sale of water filtration systems, water filters and related products and accessories.
Article 1 - Application
These general terms and conditions of sale apply, within the framework of the distance selling service, to all sales concluded via the swissaquafilter.ch website.
Article 2 - Prices
The prices of our products are indicated in Swiss Francs, all taxes included, excluding any shipping costs. All orders are payable in Swiss francs.
Promotional prices: promotions are offered on our products for a given period. Swiss Aqua Filter reserves the right to change its prices at any time, but products will be invoiced on the basis of the prices in force at the time of ordering, subject to availability. Information about prices and product availability is subject to change and is given for information only.
Article 3 - Orders
We undertake to accept your order under the terms of these general conditions of sale on our website: swissaquafilter.ch
Article 4 - Validation
When you click on the validation button after the order process, you declare that you accept the order as well as the present general sales conditions in their entirety. The data recorded by swissaquafilter.ch constitutes proof of all transactions made by its customers. The data recorded by the payment system constitutes proof of the financial transactions.
Article 5 - Availability
Our product offers and prices are valid while stocks last (unless explicitly stated otherwise). Information on product availability is provided at the time the order is placed, when the product is added to your basket. They are provided for information only. If a product is unavailable after you have placed your order, we will inform you either by e-mail or by telephone. You may then ask for your order to be cancelled or exchanged. If the goods are totally unavailable, your order will be cancelled and you will be refunded immediately. In the event of partial delivery, our customer service department will contact you to obtain your agreement to an exchange, refund, delivery extension or credit note on a future order.
Article 6 - Delivery
Products are delivered to the delivery address that you indicated during the ordering process.
The delivery time includes the time taken to prepare the parcel and the time taken to deliver it. The standard shipping method is Swiss Post parcel post. This shipping method does not require a signature from the customer.
No refund or return of order can be claimed in case of loss of the package once entrusted to the carrier.
In the event of damage during transport, a reasoned protest must be made in writing to contact@swissaquafilter.ch within three days of delivery. Swiss Aqua Filter will then take steps with the carrier (up to 15 working days) and we will keep you informed of progress. After validation of the damage by the carrier, the order will be returned to you free of charge (subject to available stock, otherwise a replacement item, a credit note or a refund will be offered).
Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer reimbursed. The exchange of any product that is subsequently declared to have been damaged during transport, without any reservation having been made on receipt of the parcel, will not be accepted.
If the delivery address communicated by the customer is incorrect and/or the delivery is unsuccessful, no return of material can be claimed before the goods have arrived back at Swiss Aqua Filter. Once the goods have been returned to Swiss Aqua Filter, the customer will be charged the actual costs of a new shipment. A full or partial refund is excluded.
In the event of a delay in delivery (from 5 working days), the customer is obliged to contact contact@swissaquafilter.ch so that we can initiate a search with the Post Office. The standard search time indicated by the Post Office is a maximum of 15 working days. Once the search has been completed, if the parcel is considered lost by the carrier, Swiss Aqua Filter will return the order to the customer in full, against payment of the carriage costs. In this case, any refund is excluded. If the package is still considered by the carrier to be in the process of being delivered, see first paragraph.
Article 7 - Delivery charges
Shipping costs include a contribution to packaging costs + postage costs. They are free for delivery in Switzerland for all orders over CHF 100.00 (one hundred Swiss francs) and for delivery in Switzerland of replacement filters as part of an annual subscription.
Article 8 - Method of payment
Payments are accepted by (Swiss) credit cards, Twint, PostFinance Card or PostFinance e-finance, Visa and Mastercard.
To avoid any risk of misuse of your credit card, Swiss Aqua Filter undertakes never to pass on your order details to any third party other than the financial organisations involved in the transaction.
Article 9 - Retention of title
The products remain the property of Swiss Aqua Filter until full payment has been received, with interest where applicable. This provision does not prevent the transfer to the customer of the risks of loss or deterioration from the moment the products leave our premises.
Article 10 - Liability
Swiss Aqua Filter shall not be held liable in the event of force majeure, climatic or political events, disruption, total or partial strike, in particular of postal services, means of transport and/or communications.
Article 11 - Intellectual Property
All elements of the swissaquafilter.ch site are and remain the exclusive intellectual property of Swiss Aqua Filter. No one is authorised to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, the elements of the site whether they be software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Swiss Aqua Filter. contact@swissaquafilter.ch
Article 12 - Warranty conditions
The guarantee does not apply to the repair of damage resulting from an external cause (accident, dismantling and repair).
It also does not apply if the problem arises from the use of a product not supplied by Swiss Aqua Filter or from improper use (with non-compatible accessories or poor maintenance). The products sold by Swiss Aqua Filter are guaranteed according to the method and duration of the guarantee offered by the manufacturer.
Steps to take if you want to activate the guarantee:
- You must first contact customer service in the contact section of the site. contact@swissaquafilter.ch
- The product must be returned in its entirety and in its original packaging with the order reference to the following address: Swiss Aqua Filter Sàrl, Rue Eugène-Marziano 15, 1227 Geneva.
- Your parts will be tested by our technicians to determine the cause of the fault.
- If all the warranty conditions are met, the faulty parts will be replaced (subject to available stock, otherwise a replacement item will be offered).
- If the parts are not faulty, but the problem arises from the way the product is used, any costs incurred in returning the product to the customer are at the customer's expense and payable in advance.
Article 13 - Return of goods
In accordance with article 40e al. 2 of the Code of Obligations, the consumer has a period of 14 calendar days to return, at his own expense, the products ordered. This right only applies to natural persons. Swiss Aqua Filter extends this period to 30 days for purchases made on swissaquafilter.ch. This period runs from the date of the order. All returns must be notified in advance to our customer service department. contact@swissaquafilter.ch
In exchange, the purchaser will receive a refund within a maximum of 30 days. Consumables such as filters that have already been used will not be taken back or reimbursed. Only products returned in their entirety, in their complete and undamaged original packaging and in perfect condition for resale will be taken back. Any product that has been damaged or whose original packaging has been damaged will not be reimbursed, taken back or exchanged.
This right of withdrawal is exercised without penalty, with the exception of shipping and return costs. If the right of withdrawal is exercised, the consumer has the choice of requesting either a refund of the sums paid or an exchange of the product.
In the case of an exchange, the return will be at the consumer's expense.
Article 14 - Annual filter subscription
Swiss Aqua Filter offers an annual filter subscription system.
When you take out an annual filter subscription, you will receive the quantity of filters you need to keep your system running smoothly for 12 months. The first shipment is made shortly before the due date for replacement of the filter(s) included in your filtration system.
For example: if you have ordered an 8.5L British Berkefeld® fountain with 2 UltraSterasyl® filters and you take out the annual filter subscription option, 6 months after your purchase you will receive 4 replacement filters for the coming year (2 filters to be changed every 6 months). Then, every 12 months, a new delivery of 4 filters.
A direct debit will be made just before the replacement filters are sent, in line with the offer you have taken out: 10% discount on the price of the filters at the time of dispatch + free delivery within Switzerland.
You can cancel your annual filter subscription at any time, up to 15 days before the due date of the next shipment, in your customer area.
Article 15 - Home installation
Installation of Doulton® under-sink water filtration systems is simple and standard.
However, we recommend that you use the services of a plumber/sanitary fitter in order to guarantee correct installation to your insurer and, if you are a tenant, to your property management company.
We are currently working on setting up a network of partner plumbing/sanitary installers throughout the country, so that we can offer you a list of professionals who are already familiar with our products, near you. In the meantime, however, the simplicity and standardisation of these installations mean that any professional plumber/sanitary fitter can install them without difficulty.
Swiss Aqua Filter cannot be held responsible for recommendations made to third parties.
Article 16 - Promotional codes and discount vouchers
Promotional codes or discount vouchers cannot be combined with each other or with any other form of discount, including promotional actions concerning all or part of the products.
In particular, promotional codes or discount vouchers cannot be combined with the 10% discount provided for annual filter subscriptions and cannot replace them.
